Terms of service
These terms and conditions (the “Site Terms”) govern access to and use of the online platform operated by Art Meets Design S.r.l. (hereinafter also referred to as “we”, the “Company” or the “Seller”) and regulate the purchase of products and/or services offered through the website https://www.thygallerystudios.com (the “Platform”).
Placing an order through the Platform implies full acceptance of these Terms. If the user does not agree with them, they must refrain from using the Platform and from placing any orders.
The processing of personal data is governed by the Privacy Policy available on the Site.
1. Definitions
Platform / Application: the website www.thygallerystudios.com and any official mobile application developed by Art Meets Design S.r.l.
User / Consumer: a natural person acting for purposes unrelated to any business, commercial, or professional activity.
Seller / Professional: Art Meets Design S.r.l.
Product(s): tangible goods and/or services sold through the Platform (e.g. clothing, merchandise, physical or digital courses).
Visitor: any person accessing the Platform without making purchases.

3. Access to the Platform
Access to certain sections of the Site is free and does not require registration. Registration may be required to access specific services or to place orders.
Browsing and using the Platform implies acceptance of these Terms.
4. User Requirements
By placing an order, the user represents and warrants that:
- they are at least 18 years old;
- they have the legal capacity to enter into binding contracts.
5. Conclusion of the Contract and Orders
5.1 Purchase Procedure
To place an order, the user must complete the electronic form by following the instructions provided on the Platform. Before final submission, the user may review and correct any errors.
By submitting an order:
- the user accepts these Terms;
- the sales contract is considered concluded;
- the user will receive an order confirmation via email.
5.2 Product Availability
If a product is unavailable, the Seller will promptly inform the user and refund any amounts already paid.
6. Prices and Payments
6.1 Prices
All prices are indicated in Euro and include VAT, unless otherwise stated. Shipping costs are indicated separately before order confirmation.
6.2 Payment Methods
Payment may be made via:
- Shopify Payments (supported credit/debit cards);
- PayPal;
- Alma;
- bank transfer (if available at checkout).
The Seller does not store or retain full payment card details, which are processed directly by certified payment providers.
If payment authorization is denied, the order will not be processed.
7. Shipping and Delivery
Shipping methods, costs, and delivery times are specified in the Shipping Policy available on the Site.
Delivery times are estimates and not binding. Delays not attributable to the Seller do not entitle the customer to compensation.
8. Right of Withdrawal
The Consumer has the right to withdraw from the contract, without providing any reason, within 14 days from the date of receipt of the products, in accordance with applicable consumer protection laws.
The right of withdrawal does not apply in cases provided by law, including:
- customized products;
- used, worn, or damaged products;
- digital content supplied via download after performance has begun.
Return shipping costs are borne by the Consumer.

All content on the Platform (texts, images, trademarks, logos, designs) is owned by Art Meets Design S.r.l. or licensed to it. Any unauthorized reproduction or use is prohibited.
11. Limitation of Liability
Without prejudice to mandatory consumer protection laws, the Seller shall not be liable for:
- service interruptions;
- indirect or consequential damages;
- improper use of products by the user.
12. Force Majeure
The Seller shall not be liable for delays or failures caused by force majeure events (e.g. natural events, strikes, network outages).
13. Governing Law and Jurisdiction
These Terms are governed by Italian law.
For consumers: jurisdiction is the court of the consumer’s place of residence or domicile.
For non-consumer users: exclusive jurisdiction is Naples.
14. Changes to the Terms
The Seller reserves the right to modify these Terms. Changes will be effective from the date of publication on the Site.
